Any person who uses the store, whether as a consumer of its services or products, or otherwise, is deemed to have fully accepted and agreed to all the provisions of this agreement. This acceptance is made with full legal capacity as recognized by Sharia, regulations, and applicable laws, and constitutes confirmation of your commitment to comply with its rules and provisions. This agreement applies to all types of interactions between the consumer and the store. It becomes effective and binding immediately upon your acceptance and commencement of registration with the store, in accordance with Article 10 of the Saudi Electronic Transactions Law.

Article 1 – Introduction and Definitions:

The above preamble is considered an integral part of this agreement. Below are the meanings and definitions of the key terms used in this agreement:

1 – (Store): This term includes all forms of the online store, whether it is a mobile application, a website on the internet, or a commercial physical store.

2 – (Consumer): The person who engages in e-commerce with the intention of obtaining the products or services provided by the store through its online platform.

3 – (Agreement): This term refers to the terms and conditions of this agreement, which govern and regulate the relationship between the parties to this agreement.

Article II-legal capacity of the consumer:

1 – The consumer acknowledges that they have the legal capacity, both legally and according to Sharia, to engage with the store, or that they are at least eighteen (18) years old.

2 – The consumer agrees that if they violate this article, they will bear the consequences of such a violation before third parties.

Article III-nature of an obligation:

1-the store's obligation to consumers or consumers is to provide ( service or product).

2 – The store may provide additional services, such as after-sales services or other related services, depending on the nature and type of the product or service requested by the consumer.

Article IV - controls on the use of :

1 – The consumer is obligated to use the store’s online platform in a manner that complies with public morals and the laws and regulations in force in the Kingdom of Saudi Arabia.

2 – When purchasing a product or service from this store, the consumer is obligated not to use the product or service in a manner that violates public morals or the laws and regulations in force in the Kingdom of Saudi Arabia.

Article V. accounts and registration obligations:

Upon applying for membership in this store as a user, you are required to disclose certain information and choose a username and a confidential password to use when accessing the store’s services. By doing so, you agree to:

1 – To be responsible for maintaining the confidentiality of your account information and password, and to agree to immediately notify the store of any unauthorized use of your account information or any other breach of your confidential information. 

2 – The store shall not, under any circumstances, be held responsible for any direct or indirect, tangible or intangible loss you may incur as a result of the disclosure of your username or password.

3 – You are obligated to use your account or membership with the store personally, as you are fully responsible for it. If someone else uses it, this shall be considered evidence that you have authorized them to use the store under your name and account.

4-you are committed when using the store to use it with all seriousness and credibility.

5 – You are obligated to provide truthful, accurate, up-to-date, complete, and lawful information about yourself as required during registration with the store, and you must update your information if it changes in reality or whenever necessary.

6-our store is committed to treating your personal information and contact addresses with strict confidentiality.

7 – If the store determines that you have provided false, inaccurate, outdated, incomplete, or unlawful information, or information that violates the Terms of Use, the store reserves the right to suspend, freeze, or cancel your membership or your account on the platform, without prejudice to the store’s other rights and its lawful means to reclaim its rights and protect other consumers.

8 – In the event of non-compliance with any of the above, the store management reserves the right to suspend or cancel your account or membership, or block your access to the store’s services.

Article VI-electronic communications and official means of communication:

1-the parties to this Agreement agree that communication is carried out by e-mail registered in the platform.

2 – The consumer agrees that all agreements, advertisements, statements, and other communications provided electronically shall have the same effect as their written counterparts and serve as standalone evidence in fulfilling legal and regulatory requirements.

3 – The consumer agrees to be contacted and notified of any provisions related to this agreement or their dealings with the store through the store management sending general messages to all consumers or to specific users of the store.

Article VII-amendments to the usage agreement and fees:

1 – If any article or clause in this agreement is revoked or becomes unenforceable, this shall not invalidate the remaining articles, clauses, rules, and provisions of this agreement, which shall continue to remain in effect until further notice from the store management.

2 – This agreement, which may be amended from time to time as necessary, constitutes the framework for operation, understanding, and agreement between the Consumer and the Store. 

3 – The store may impose fees on certain consumers, depending on the offers, products, or services they request, or based on any fees or taxes imposed by the state on the nature of the product or service.

4 – The store reserves the right to add, increase, reduce, or waive any fees or expenses under the terms and provisions of the Terms of Use Agreement, for any consumer regardless of the reason for their registration.

Article VIII-payment and payment services for stores in the store

1 – The store, through its partners, provides a payment system that allows transactions to be completed entirely online using the payment options available on the store, or through any other payment method the store may offer from time to time.

2 – The store is committed to setting the price of any product or service it offers in its store according to the prevailing market value.

3 – The store is committed to providing invoices, receipts, and acknowledgment slips for all amounts and revenues generated in its store, and it is obligated to provide the consumer with a purchase invoice for any product or service.

4 – The store is committed to providing the standard accounting specifications on its online store, in accordance with the provisions of this agreement and for the legal, economic, commercial, and organizational interests established by these regulations.

Article IX-intellectual property:

1 – The intellectual property rights of the store are fully owned by the store, whether they were acquired before or after the establishment of this online platform.

2 – The consumer shall respect the store’s intellectual property rights, including the store’s name, words, logos, and other symbols associated with or displayed by the store, as all rights linked to the store’s name are fully owned intellectual property of the store.

Article X - responsibility of the store:

1 – The store is committed to conducting its business through this online platform in a lawful manner, in accordance with the regulations in force in the Kingdom of Saudi Arabia and the provisions of this agreement.

2-the store shall not bear any claims arising from errors or negligence, whether caused directly, indirectly, accidentally, by the consumer or by a third party such as shipping companies.

3 – The Saudi Medical Store, its staff, owners, and representatives are committed to ensuring that any product or service is safe, lawful, and authorized in accordance with the laws and regulations of the Kingdom of Saudi Arabia, and that it is used for legitimate purposes.

Article XI - restriction of access or membership:

The store may suspend or cancel a consumer’s membership, or restrict their access to the platform’s services, at any time, without prior notice, for any reason, and without specification.

Article XII. applicable law or regulation:

This usage agreement is governed and formulated in accordance with the laws, regulations and legislations in force and in force in the kingdom of Saudi Arabia, and is fully and completely subject to the regulations in force with the authorities in the kingdom of Saudi Arabia.

Article XIII. general provisions: 

If any article or clause in this Terms of Use Agreement is canceled or becomes unenforceable, this shall not affect the validity of the remaining articles, clauses, and provisions of the agreement, which shall remain in effect until further notice from the store management.

This Terms of Use Agreement, which may be amended from time to time as necessary, constitutes the framework for use, operation, understanding, agreement, and contracting between the store and the consumer. Both parties to this agreement also agree to take the following into consideration:

1-the Arabic language shall be the applicable language when interpreting the provisions of this agreement, or when translating them into another language.

2-all prices displayed on the services or products of the store may be amended from time to time.

3-the promotional or marketing offers that the store may place are temporary offers, as the store has the right to modify these promotional or marketing offers at any time or stop them.

4 – The parties to this agreement are obligated to conduct their dealings in a manner that complies with Sharia principles, as well as the applicable laws and regulations related to the nature of the relationship between the store and the consumer.

5 – This Terms of Use Agreement can only be terminated by a decision issued by the store management.
